Seven candidates, from two different political parties, have joined together to fight the Kentucky machine. One ordinary citizen has galvanized this action and stopped this very important case from being dismissed.
When Glenda Young called Black Box Voting she was a woman with a mission. "I need a lawyer," she said. "Can you help?"
Her plain spoken Southern drawl was laced with urgency and determination. "I believe that a great injustice has been done. When seven candidates join together from different parties to contest an election because they believe it was not honest, something's terribly wrong."
After questioning her, Kathleen Wynne of Black Box Voting was sufficiently concerned about procedural violations in the election that she took it upon herself to contact several attorneys on Glenda's behalf. The first attorney to understand the urgency and importance of this case was Paul Lehto, a formidable advocate for clean elections from Everett, Washington.
The candidates had already filed a case with local counsel, and a motion had been filed to dismiss. Lehto wasted no time catching a plane to Kentucky. After meeting with candidates, who provided hair-raising accounts of election irregularities, Lehto stepped in to fight the dismissal with the aid of local attorney Leroy Gilbert.
According to Lehto & Gilbert's legal brief:

The Court must recall at all times that the voting here in question involves invisible electronic ballots which have not been inspected at any time by any party hereto, even the County Clerk has not counted them. Rather, the electronic ballots have been purported to be counted in secret by trade secret counting software owned by the vendors.
There is no reason at all or basis for confidence in the electronic counting until verified by the plaintiffs not only because the Clerk himself is a defendant-candidate here, but also because it is the nature of the computer to do precisely as it is told without reference to any laws, morals or ethics.

Lehto explains: "Computers do what they're told -- without regard to laws, ethics or morals, and THAT's the problem. They can put computers into elections when they find a computer that fears going to jail."

Glenda Young is a prime example of the backbone of America. One person CAN make a difference. When she called Black Box Voting, we realized that she was as serious as a heart attack. It was clear that there was no way she was going to back down, whether we helped her or not. This is the kind of tenacity it's going to take to reclaim our elections.
"I never believed this would happen in my own back yard," Young says. "It is up to us as the people of America to take a stand."
Lehto explains:
"For all the talking points of elections officials about pre-election testing, post-LAT testing, parallel testing, ITA certification, etc., the ONLY relevant question is WHAT WAS THE MACHINE TOLD TO DO ON ELECTION DAY ITSELF?
"We don't doubt that the machines CAN count correctly...We wonder what they were told to do on election day that causes either a malfunction (because computers are so complicated and literal) or causes a fraud (because computers will do ANYTHING)."
The evidenciary phase of this case has not been opened yet, but when candidates from two parties join together to file a joint lawsuit, red flags go up like the Fourth of July.
Seven candidates. Two lawyers. One ordinary citizen with firm resolve.
This is an example of what you can accomplish. Now, to expand on this: We cannot overstate the importance of getting involved and gathering real evidence. Evidence = photographs, audio recordings, video, and public records.
There are no small elections. Every election represents the integrity of the machinery and the procedures for the jurisdiction itself. If there is a problem with a local race, you can't have confidence in any race above it.
"We're counting the votes. Get over it."

[1]The first of several federal whistleblower qui tam (fraud) suits have now been filed against one of America's major electronic voting machine companies, The BRAD BLOG [2] can now report.
Florida attorney Mike Papantonio who, along with Robert F. Kennedy, Jr. hosts Ring of Fire [3], weekends on Air America Radio [4], was a guest on Mike Malloy's radio program last night. [Complete audio is available at bottom of this article.] He discussed the upcoming whistleblower suits that he and Robert F. Kennedy, Jr. are filing against several of the voting machine companies. Pap was loaded for bear.
During the interview, he gave several new details on the federal fraud suits now being filed, which include several whistleblower plaintiffs whose stories were originally reported here at The BRAD BLOG [2], as mentioned last week in a quick item here [6], with some fresh details of our own. Pap reported last night that the "dream team of lawyers" they've assembled to take on these evil, irresponsible, anti-American companies includes a bunch of those who took on the tobacco companies in a successful quarter billion dollar suit — so they're not likely easily intimidated, we'd think.
Papantonio is a senior partner at Levin Papantonio Thomas Mitchell Echsner & Proctor, P.A., a Pensacola lawfirm. (website here [7]) RFK Jr. is also "of counsel" for this firm.
Speaking of the level of fraud to be revealed by the suits, which must be sealed by law for 60 days as the Attorney General decides if they will join the complaint, Papantonio told Malloy: "When you hear the details, when you hear the caliber of the fraud… you… it'll make Americans feel like they're living in a damned banana republic, a third world country. I have never heard such outrageous facts."
"And you know what?" he continued, "We've had our investigators look at it. We verified everything. And when you hear it, you're gonna say, 'Not in America.' …Bad news is: Yeah, it is in America."
The fraud suits, Papantonio said, are "a way to get at their money, and that's the only thing these people understand."
"At the end of the day, we're gonna shut down some of these companies," Papantonio said. "Some day these hacks are gonna be across the table from me, and they're gonna have to answer the questions that nobody else has been able to ask them."
Pap excoriated the DNC, "the indolent Democrats and the lazy media," for not participating in any of this, and decried the fact that he and RFK Jr. were essentially forced to take action on their own, given the Dems' failure to do anything.
He also spoke of the voting machine "sleepovers" about which we've been reporting here in detail of late. As well, he had several kind words for this website and several other election integrity groups. "Unless you had these organizations out there like Black Box Voting or BRAD BLOG, people like that, paying attention to this, this wouldn't even be on the radar screen," he said.

UPDATE: AP finally notices [9] the spate of lawsuits being filed against these e-voting companies and their shitty wares across the country. AP is still way behind us here at The BRAD BLOG [2], of course, and haven't noticed the RFK Jr. suits, but hey, they don't have the access to the huge resources and manpower that we are able to leverage here, with our enormous staff and boundless funding, so we'll cut AP some slack. They're just a little blog or something, right? I'm sure they're doing their best. Thanks to Pam of The Democratic Daily [11] for the heads up!

Thank you, MAJI, for that great contribution. We're working on ending that vote fraud and manipulation, but have a long way to go. I hope people will post anything else about what we can do and that is being done here too. We're going to have to get involved to make that stop, that's all there is to it. Contributions to organizations like "Black Box Voting" help alot to get that job done too. I donate money to that organization. It was one of the very first ones to begin working on the vote fraud and manipulation that was in the 2000 and 2004 elections and will be in all the other ones coming up if it's not stopped. "Black Box Voting" is a grassroots organization that has been very influential and is getting the job done, so I recommend it.

DNC Voting Rights Institute on CA-50 Special Election
For several weeks since the June 6th Special Election in California’s 50th Congressional District there have been reports of election irregularities. The DNC Voting Rights Institute (“VRIâ€) has been monitoring the developments since Election Day and has raised a number of concerns regarding new and disturbing information.
First and foremost is the fact that any election where there are allegations of machine tampering, break downs in chain of custody, security breaches and other such irregularities must be taken seriously. There are several facts in this race that raise very deep concerns.
On the facts:
1. We know for a fact that San Diego County election officials have admitted that a number of the voting machines were taken home in violation of the federal security regulations and guidelines and that a number of the machines showed evidence of tampering (broken seals, which should also have immediately disqualified those machines from use according to state laws implemented in just the last several months in response to new severe vulnerabilities discovered Diebold's optical-scan and touch-screen voting systems.)
2. We know that under state and federal guidelines, any such breach of security seals or the new "secure storage" requirements for these machines and their memory cards should have immediately disqualified those machines from use in the election for the reason that they became effectively decertified for use upon such security and chain of custody violations.
3. We also know that both the Diebold optical-scan and touch-screen (DRE) machines have been proven to be vulnerable to tampering in test after test by industry experts, including a team of computer scientists and security experts convened by California's Secretary of State in response to recent revelations concerning the hack ability of Diebold voting systems.
4. We know that serious security issues and efforts by Diebold to obfuscate problems with their hardware and software led California’s former Democratic Secretary of State to decertify Diebold touch-screen systems in 2004,[/U] only to have the Republican Secretary who succeeded him reinstitute the machines over the objections of scores of computer scientists and experts
and hundreds of election integrity advocates.
The San Diego County election official responsible for administrating post-election manual vote counts has given three different arbitrary cost estimates for conducting the hand count. The quoted fees are as much as six times the costs estimates for similar hand counts in surrounding counties. The estimates portray the expense of a manual vote count to be cost prohibitive.
This is no longer about whether or not Busby or Bilbray won the election on June 6th. This is about the importance of verifying the facts related to election and voting machine irregularities in this race and the need to ensure an accurate count of all votes cast in this election so that the electorate may have confidence in the announced results in future elections.
The VRI will continue to monitor facts as they become available and will call for a swift and verifiable "manual count" of all 150,000 ballots cast in California’s 50th District’s "bellwether" June 6th special election in order to ensure the integrity of November 7th general elections and the overall integrity of our country’s voting systems in this still-untested age of computerized voting.

Weird news of the day:
As if the "sleepovers" in San Diego County weren't odd enough given the security defects exposed by Black Box Voting -- in Cuyahoga County Ohio (Cleveland area) the Diebold memory cards -- which are actually BALLOT BOXES -- were toted around in Yellow cabs with only one driver guarding piles of them at a time.
Strangely, the Yellow cab drivers understood instinctively what not a single person in the Cuyahoga County elections division seemed to "get": Yellow Cab Company wrote a letter to the elections division objecting to being stuck with inappropriate chain of custody and refusing to take the rap when dozens of ballot boxes were missing (12 are STILL missing).
Two members of the Cuyahoga County elections board have called for the resignation of Director of Elections Michael Vu after multiple other problems. Great link Jennifer! You're like a breath of fresh air! I've been on this site for eons it seems ... :p ... talking about the broken elections. MAGI too. It's great to have you here. :thumbup:
Things are getting a little better in Tennessee. A group I've been involved with monitored the primaries for the first time this past Thursday. The general population still doesn't understand we can't trust the actual machine sometimes, we can't trust that the voting information won't be hacked somewhere along the long electronic line and we can't trust the corporations that own the rights and have fought in court to protect their exclusivity against the public's interest. Plus we need videotaping and verified ballots ... etc.... etc. But people ARE waking up.

Hi, Jane of Arc and MAJI. Jane of Arc, that's wonderful you're working with a small group in Tennessee to get the vote right. Small committed groups like that are the most effective I think. I've noticed in life that if you want something done and done right, the best, and often the only way for that to happen is to do it yourself. There's a great sense of accomplishment in it too when it's finished. Let's keep working on getting the vote right untill the job is done. Caring, really caring, goes a whole ways and, by other people noticing that we do care and that we are working for the good of everyone, it acts as a great motivator for them to pitch in and help out too. It's good that so many organizations are getting involved in pushing for a re-vote in the 13th District. To be honest, I didn't pay much attention to voting rights issues before this year's election season. But after this experience, I'm definitely going to be more active in this area. This has become a big deal for me. People go out to vote feeling like they're making their voices heard, and then crap like this happens. It's just not right.
